Kansas is a no-fault state with a 60-day waiting period. What happens inside those 60 days decides the next ten years.

What counts as family law in Kansas?

Divorce and legal separation, child custody and parenting time, child support, spousal maintenance, property and asset division, paternity, adoption, guardianship, and modifications to any order already in place. Most cases involve several of these at once.

Which court will hear my case?

Residents of Overland Park, Leawood, Shawnee, Stilwell and Mission Hills file in the Johnson County District Court in Olathe. Kansas City cases can fall on either side of the state line, which is why being licensed in both Kansas and Missouri matters here.

How long do I have to have lived in Kansas to file?

Under K.S.A. 23-2703, you or your spouse must have been a Kansas resident for at least 60 days before the petition is filed.

Can an existing order be changed?

Yes, where there has been a material change in circumstances. Custody, residency, parenting time and support can each be modified, and the burden differs between them.
