Fairway Divorce and Family Law Attorney

Fairway is small, established and professional, and its divorces tend to involve something that has to be valued rather than counted. When one spouse owns a practice or a partnership interest, the case is decided by what that interest is worth.

Family law in Fairway

Start with whichever one brought you here

Each of these runs on its own rules, its own court and its own clock. Most people arrive with one in mind and find that two or three of them are really the same problem.

Divorce in Fairway

Kansas is a no fault state, so nobody has to prove wrongdoing. One of you must have lived in Kansas for 60 days before the petition is filed, and another 60 days must pass before a judge may grant the decree, which makes a straightforward Fairway divorce a two month case at its very fastest.

Those 60 days are a floor rather than a forecast. The waiting period only decides the length of a case if everything else is agreed by the time it runs out. What usually sets the real timetable is how long it takes to value what the two of you own and to settle a schedule for the children.

Temporary orders are the part most people underestimate. In the opening weeks either of you may ask the court to decide who stays in the house, who pays which bill and what the parenting schedule looks like while the case runs. Those orders often become the pattern the final decree is measured against, which is why the first month tends to matter more than the last.

What usually decides it

  • Whether it is agreed

An uncontested case can finish close to day 60. A contested one is only getting started at day 60.

  • What you own together

A house with equity, a retirement account or a share in a business has to be valued before it can be divided.

  • Whether there are children

A parenting plan has to be in place before a decree, so custody and support usually set the timetable.

  • Where you have lived

One of you needs 60 days of Kansas residence before a petition can be filed at all.

Valuing a business in a Fairway divorce

A medical, dental, legal or consulting practice is an asset, and in a Fairway divorce it is frequently the largest one. Its value is not the number on a tax return and it is not the balance in the business account. It is what the practice is worth as a going concern, which takes a forensic accountant or a valuation expert rather than an argument between spouses.

Goodwill is where these cases actually get fought. Some of a practice's value attaches to the business itself and some attaches personally to the professional who runs it, and the two are treated differently. Getting that split wrong in either direction moves the number by a great deal, and it is the part a general practitioner is least likely to press on.

Income is the second problem. A practice owner's compensation is a decision as much as a fact, and distributions, retained earnings and perquisites that run through the business can all understate what is genuinely available for support. Kansas looks at income rather than at salary, and establishing the difference takes documents.

Long marriages and spousal maintenance in Fairway

Fairway's housing turns over slowly and marriages here are often long, which puts spousal maintenance squarely on the table alongside the practice valuation. When one spouse supported the other through training and then ran the household, that contribution is a factor the court weighs, and it is proven with a history rather than asserted in a hearing.

Filing a Fairway case at the Johnson County District Court

Fairway is in Johnson County, so a case from here is filed at the Johnson County District Court, 100 N. Kansas Ave., Olathe, Kansas 66061.

Olathe is the far side of the county from Fairway. When a practice valuation is in play, the case will involve more settings than an ordinary one, so the travel is worth planning for rather than absorbing.

Schools and parenting time in Fairway

Shawnee Mission USD 512 serves Fairway. Long marriages and slow housing turnover mean children here frequently stay in one district throughout, and disrupting that is a harder argument to make than preserving it.

How a family law case moves in Kansas

Kansas cases run on a court calendar. Divorce's is sixty days by law.

Divorce, custody, child support, adoption and guardianship each move through Kansas courts on their own schedule. Divorce's is fixed by statute, which makes it the clearest one to show here: the sixty days below is a floor, not a forecast. An uncontested divorce may finish close to day sixty, and a contested one is only getting started. If yours is one of the others, a call sorts out what your own timeline looks like.

Answers

Frequently asked questions

Is my spouse entitled to half my practice?

Kansas divides marital property equitably, which means fairly rather than automatically equally, and a practice is one asset among all the others. In most cases one spouse keeps the practice and the other is compensated elsewhere in the estate rather than the business itself being split.

Do we really need a forensic accountant?

Not in every case, but where a practice, partnership interest or closely held business is involved, a valuation from someone qualified to give one is usually the difference between negotiating over a real number and negotiating over two guesses.
