One city, two counties, two courthouses

Venue follows the county, not the city or the postal address. A Spring Hill household on the Johnson County side files at the Johnson County District Court in Olathe. A Spring Hill household on the Miami County side files at the Miami County District Court in Paola, in a different judicial district with a different bench and a different docket.

That is worth confirming before anything is filed rather than after. Filing in the wrong county is recoverable, but it costs weeks at the point in a case when weeks are least affordable, and temporary orders are usually what the delay holds up.

It can also change the feel of the case. Johnson County runs a large, busy docket. The Sixth Judicial District, which covers Miami along with Linn and Bourbon counties, is smaller, and a smaller bench usually means fewer settings and a judge who becomes familiar with your file.

How do I know which county my Spring Hill address is in?

The county appears on your property tax records and your vehicle registration, and it is not always what people assume from the postal address. It is worth checking before filing, because Johnson County cases go to Olathe and Miami County cases go to Paola.

Does moving across the county line change my children's school?

Usually not within Spring Hill, because USD 230 serves the city on both sides of the line. It can still change which courthouse handles a future modification, so an order made in one county and a family later living in the other is worth raising with us.
