Residency and filing for divorce in Grain Valley

Missouri requires one party to have been a resident of the state for 90 days before a petition for dissolution can be filed. For a family that moved here in the last few months, that is a real wait, and it is a wait that begins on arrival rather than on the day anyone decides to separate.

If the other spouse is still in the state you moved from, that state may still be able to take the case, and it may be able to take it sooner. Whether to wait for Missouri or file where you came from is a genuine strategic decision with different consequences for support, custody and timing.

Once the 90 days are met, Missouri moves comparatively quickly: only 30 days need pass after filing before a court may enter judgment, against 60 in Kansas. A case that is slow to start here can be quick to finish.

Newer homes and thin equity in Grain Valley

Missouri requires one party to have been a resident for 90 days before a petition for dissolution is filed. If neither of you has reached that and your spouse remains in another state, filing there may be possible sooner, which is a decision worth taking advice on.

Does a recent move hurt me on custody?

Not in itself, but continuity matters to a court, and a child who has just started somewhere has less of it to point to. That works both ways in a relocation dispute, and it is better addressed directly than left for the other side to raise.
