Missouri is a no fault state, but the clock is not the Kansas clock. You need 90 days of Missouri residence before filing, and 30 days must pass after filing before a judgment may be entered, so an Independence case is slower to start and quicker to finish than one across the state line.

Those 30 days are a floor rather than a forecast. Missouri lets an agreed case finish sooner than Kansas does, but the 90 day residency at the front means a family that has recently moved to Independence may have to wait before they can file at all.

Temporary orders are the part most people underestimate. In the opening weeks either of you may ask the court to decide who stays in the house, who pays which bill and what the parenting schedule looks like while the case runs. Those orders often become the pattern the judgment is measured against, which is why the first month tends to matter more than the last.

Two courthouses, one circuit

The 16th Judicial Circuit's Family Court has exclusive original jurisdiction over marriage and child custody matters, and it hears them at more than one location. Depending on the case, that is the Eastern Jackson County Courthouse in Independence or the Family Justice Center at 625 E. 26th Street in Kansas City.

For most Independence households the eastern courthouse is the relevant one, which is a real practical advantage: a morning setting is a short trip rather than a drive downtown and a parking problem. Confirm the location before every appearance rather than assuming, because the assignment follows the case type.

How Missouri divorce law differs, for Independence families

Missouri dissolution runs under Chapter 452. The court dissolves a marriage on a finding that it is irretrievably broken, and it decides custody by weighing the statutory best-interests factors rather than any single test. Each parent is expected to put forward a parenting plan.

The timing differs from Kansas in both directions. Ninety days of residence are needed before filing, which is longer than Kansas, but only thirty days must pass after filing before judgment can be entered, which is shorter. A family that has recently arrived in Missouri may need to wait to start, and then find the case moves quickly once it does.

Support is calculated on Form 14, which produces a presumed amount the court can rebut when it would be unjust or inappropriate. That rebuttal is an argument worth making properly when the standard calculation genuinely does not fit a household, and it is not made by simply disagreeing with the number.
