Raytown Divorce and Family Law Attorney

Raytown is an older inner-ring suburb where most divorces are decided by the monthly numbers rather than by what anybody owns. Missouri calculates support on Form 14, and in a household with no slack in it, getting that form right is the whole case.

Family law in Raytown

Start with whichever one brought you here

Each of these runs on its own rules, its own court and its own clock. Most people arrive with one in mind and find that two or three of them are really the same problem.

Divorce in Raytown

Missouri is a no fault state, but the clock is not the Kansas clock. You need 90 days of Missouri residence before filing, and 30 days must pass after filing before a judgment may be entered, so a Raytown case is slower to start and quicker to finish than one across the state line.

Those 30 days are a floor rather than a forecast. Missouri lets an agreed case finish sooner than Kansas does, but the 90 day residency at the front means a family that has recently moved to Raytown may have to wait before they can file at all.

Temporary orders are the part most people underestimate. In the opening weeks either of you may ask the court to decide who stays in the house, who pays which bill and what the parenting schedule looks like while the case runs. Those orders often become the pattern the judgment is measured against, which is why the first month tends to matter more than the last.

What usually decides it

  • Whether it is agreed

An uncontested case can finish close to day 30. A contested one is only getting started at day 30.

  • What you own together

A house with equity, a retirement account or a share in a business has to be valued before it can be divided.

  • Whether there are children

Missouri expects a written parenting plan from each parent, so the children's arrangements usually set the timetable.

  • Where you have lived

One of you needs 90 days of Missouri residence before a petition can be filed at all.

Form 14 is not a formality

Missouri's presumed child support figure comes out of Form 14, which takes both parents' gross incomes and then adjusts for other children, work-related childcare, health insurance and extraordinary expenses. Each of those is a line somebody has to fill in correctly, and each of them moves the number.

The court can rebut the presumed amount when applying it would be unjust or inappropriate, but that is an argument built on evidence rather than on disagreeing with the total. If the standard calculation genuinely does not fit your household, that case has to be made properly and it has to be made before the order is entered.

When income is irregular, a figure built on a good month is one somebody will be back in court about. A full year of records usually produces an order that holds.

Dividing the house and retirement accounts in a Raytown divorce

Raytown's housing is older and generally affordable, so the estate is usually a house with moderate equity, two vehicles and whatever retirement has been accumulated. That leaves very little room for error, which makes the temporary orders entered in the first weeks unusually important: they decide who stays, who pays what, and the pattern everything after is measured against.

Retirement is the part people undervalue. An account nobody can draw on for twenty years is still marital property, and where it is the largest asset in the marriage, dividing it correctly matters more than the argument about the furniture.

Filing a Raytown case at the 16th Judicial Circuit Court of Missouri

Raytown is in Jackson County, so a case from here is filed at the 16th Judicial Circuit Court of Missouri, Eastern Jackson County Courthouse, 308 W. Kansas Ave., Independence, Missouri 64050.

Raytown is wrapped by Kansas City on three sides, which leads people to assume their case belongs wherever their post is delivered. It does not. Raytown is Jackson County, and the case is heard at one of the circuit's family locations, usually the Eastern Jackson County Courthouse in Independence.

Schools and parenting time in Raytown

The Raytown C-II School District serves the city. When a household is stretched, the drive to school is often the real constraint on a parenting schedule, and a plan that ignores who can physically do it at 7am is a plan that fails in the first month.

How a family law case moves in Missouri

Missouri cases run on a court calendar. Divorce's is thirty days after filing.

Divorce, custody, child support, adoption and guardianship each move through Missouri courts on their own schedule. Divorce's is fixed by statute, Chapter 452 RSMo: ninety days of residency before filing, then thirty more before a judgment. That makes it the clearest one to show here. An uncontested case may be finalized close to day thirty; a contested one is only getting started. If yours is one of the others, a call sorts out what your own timeline looks like.

Day 00

Petition filed

The thirty-day clock starts here. Temporary orders for support, the house and parenting time can be requested the same week.

Answers

Frequently asked questions

My address says Kansas City but I live in Raytown. Where does my case go?

Raytown is in Jackson County, Missouri, and postal addressing does not decide venue. Your case is heard by the 16th Judicial Circuit at one of its family locations, most often the Eastern Jackson County Courthouse in Independence.

Can the Form 14 amount be changed?

The court can rebut the presumed figure when applying it would be unjust or inappropriate, but that takes evidence rather than objection. If the standard calculation does not fit your household, make that case before the order is entered rather than afterwards.
